Terms of Sale

1. Validity of the Terms of Sale

1) These Terms of Sale apply to purchases of goods and services from the online store www.dinascloset.ee between the buyer (hereinafter the Consumer) and the company Dina’s Closet OÜ (hereinafter the Online Store dinascloset.ee).

2) In addition to these Terms, relations arising from purchases in the dinascloset.ee online store are governed by the laws in force in the Republic of Estonia, in particular the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legal acts.

3) The online store dinascloset.ee reserves the right to amend the Terms of Sale. Such amendments will be reflected on the website www.dinascloset.ee.

2. Pricing information

1) Dina’s Closet OÜ is not registered as a VAT payer.

2) The purchase price is subject to additional transport (shipping) costs according to the delivery method selected by the Consumer.

3. Placing an order

1) Add the desired products to the shopping cart.

2) To place the order, first click the “Proceed to payment” link in the shopping cart.

3) On the order placement page, fill in the required fields.

4) Choose a suitable delivery method and click “Continue”.

5) Carefully complete the fields on the data and order confirmation page, since the speed and trouble-free delivery of the products you purchased and the resolution of any later disputes and claims depend on the accuracy and correctness of the information provided.

6) If an order is submitted on a working day before 16:00, we will dispatch the parcel the same day. If the order is submitted on a working day after 16:00, we will dispatch the parcel on the next day. Orders submitted after 16:00 on Friday, during weekends and on public holidays will be dispatched on the next working day.

4. Formation of the sales contract

1) By the sales contract the online store dinascloset.ee undertakes to deliver to the Consumer goods that exist, are being manufactured or will be acquired by the online store dinascloset.ee in the future, and to enable the transfer of ownership to the Consumer; the Consumer undertakes to pay the amount specified on the invoice issued by the online store dinascloset.ee for the goods and to accept the goods.

2) Orders that have not been paid for will be cancelled 3 days after the order was placed.

3) The sales contract takes effect after the payment made by the Consumer has been received in the bank account of Dina’s Closet OÜ.

5. Delivery and receipt of goods

1) After the sales contract takes effect, the goods will reach the Consumer no later than within 3 working days.

2) For prompt delivery you must be careful and provide truthful and valid delivery information when placing the order.

3) Before using the product, check that:

- the product corresponds to your expectations (color, size);

- the product has not been damaged during transport.

6. Right of withdrawal (returns)

1) The Customer has the right to withdraw from the transaction without giving a reason within 14 calendar days. To return a product, please send a notice of withdrawal from the contract to our e‑mail address dinascloset@gmail.com. Please include the following information: A template of the withdrawal statement for a distance contract or a contract concluded outside business premises:

- To whom;

- Hereby I withdraw from the contract (order/invoice number) concerning the item which is the product (product code and size);

- Order submission date / Product receipt date;

- Consumer’s name;

- Consumer’s address;

- Date.

2) The 14‑day return/exchange right does not apply to goods purchased in the physical store on site. It also does not apply to underwear/bikinis if the packaging has been opened.

3) The Consumer is liable for the reduction in value of the item resulting from handling the item beyond what is necessary to establish its nature, characteristics and functioning. To establish those features the Consumer should handle and use the item only as they would be allowed to do in a regular store. The Product subject to return or exchange must not show signs of use (soiling, perfume odor, damage), and returned goods must have their tags and original packaging. If the returned goods are damaged or tags removed, a decision will be made as to whether and to what extent a refund will be given.

4) The Consumer must return the goods within 14 days following the expression of the wish to return them or provide proof that they handed the goods to the logistics company within the aforementioned period; return-related costs are borne by the Consumer.

5) The online store dinascloset.ee will refund the amount to the Consumer upon receipt of the withdrawal statement without undue delay, but not later than within 14 days from receipt of the statement, of all payments received from the Consumer under the contract, unless clause 6.3 applies.

7. Force majeure

1) The online store dinascloset.ee is not liable for damages caused to the Purchaser or for delays in delivery of goods if the damage or delay is due to circumstances that the online store dinascloset.ee could not influence or foresee.

8. Procedure for submitting claims (complaints)

1) The online store dinascloset.ee is liable to the Consumer for non‑conformity or defects of the sold goods that become apparent within two years from the delivery of the goods to the Consumer. For defects that appear within the first 6 months the trader (seller) determines the cause of the defect.

2) The Consumer has the right, upon detection of a defect, to contact the online store dinascloset.ee within two months, submitting the invoice by which the goods were purchased.

3) If a defect is found, please discontinue use of the goods.

4) Repair or replacement of defective goods is carried out in accordance with §§ 222 and 223 of the Law of Obligations Act.

- For defects that appear within 6 months from the day of delivery, the trader determines the cause of the defect; after that (up to 2 years from delivery) the claimant must prove the cause of the defect, agreeing with the trader on the form of proof. Reasonable costs related to proving the defect are borne by the party for whose detriment the proof result is.

- According to §§ 222 and 223 of the Law of Obligations Act the claimant may, if the goods do not conform to the agreed terms, demand from the trader: primarily repair of the item; replacement of the item if the trader considers repair impossible or would cause unreasonable costs; *in case of significant defects (e.g., where repair or replacement is impossible or fails or causes unreasonable inconvenience to the claimant) the claimant has the right to withdraw from the contract.

5) The online store dinascloset.ee is not liable for defects caused by the Consumer’s improper storage or misuse of the product.

6) In case of non‑conformity or defects, please send a complaint to dinascloset@gmail.com indicating the name of the person who placed the order, contact telephone number, order number and an exact description of the non‑conformity or defect.

7) A complaint regarding detection of non‑conformity or a defect must be submitted within two months from the discovery of the non‑conformity or defect.

 All complaints will be reviewed and the Consumer will be contacted as soon as possible, but not later than within 15 days from receipt of the complaint.

 The Consumer has the right to demand a reduction of the purchase price or termination of the contract and a refund of the purchase price if the online store dinascloset.ee cannot repair or replace the goods, if repair or replacement fails, if the online store dinascloset.ee has not remedied the defect within a reasonable time, or if the Consumer has suffered unreasonable inconvenience. The Consumer has the right to claim interest if the trader fails to return money within the correct time.

9) In accordance with care instructions, products to be claimed/returned/sent must be cleaned.

9. Consumer’s right to apply to the Consumer Disputes Committee

1) If the Online Store has refused to resolve the Consumer’s complaint or the Consumer does not agree with the solution offered by the Online Store and believes that his/her rights have been violated or interests harmed, the Consumer may submit a complaint to the Consumer Disputes Committee via the Consumer Protection Board or to a court. The Consumer may submit the complaint personally or through a representative. The contact details of the Consumer Disputes Committee are available on the website of the Consumer Protection Board.

2) If the Consumer is located outside the Republic of Estonia, it is possible to submit a complaint via the European Consumer Centre in the EU Member States.
